Terms of Service
The plain-English rules of using XPGames. Read this before submitting a batch.

Who we are, what this is
XPGames is a video-game buyback service based in Whitby, Ontario, serving Durham and the Toronto GTA. We buy used video games, consoles, controllers, and accessories from customers. These Terms cover what you can expect from us and what we expect from you when you use xpgames.ca.
By creating an account or submitting a batch, you agree to these Terms and to our Privacy Policy.
Payouts: what the numbers on the site mean
The payouts listed on /pricesand the batch total shown on your submission represent what we'll pay ifthe items match the condition you selected. They're our standing offer subject to one check: the actual condition of the items when we receive them.
We'll always review the items in person before finalizing the payout. If something arrives matching the condition you selected, you get the listed payout for that condition, no surprises.
Condition matters: adjustments and deductions
For each item, you tell us the condition: New / Sealed, Complete-in-Box, Missing Manual, or Loose. Each condition has its own payout.
When your items arrive, we inspect them. If an item is in a worse condition than you selected, we'll adjust the payout to match what the item actually is. For example:
- A game listed as “Complete in Box” but missing the manual drops to the Missing-Manual payout.
- A “Loose” cartridge that arrives non-functional may not get a payout for that item.
- A console without controllers or power cables may drop a tier (the payout list shows these tiers explicitly).
We send you a final-payout email after the inspection with each adjusted line, the reason for any adjustment, and the new total. You can always reply with questions.
No returns
Items you send in are not shipped back.If we adjust the payout for an item or decide we can't pay anything for it, the item stays with us. We don't offer return shipping. It's simply not part of the service.
Please double-check your condition selections before submitting. If you're unsure about an item's condition, choose the lower tier or contact us first at xpgames4less@gmail.com.
If you disagree with an adjustment, reply to the final-pricing email and we'll work it out. We're reasonable.
Items we don't accept
- Counterfeit / reproduction cartridges, discs, or accessories.
- Stolen items. (You confirm that anything you sell us is legally yours.)
- Heavily damaged items beyond the “Loose” tier, like broken-in-half cases, water-damaged hardware, etc.
- Items missing critical components beyond what our condition tiers cover.
- Anything outside our catalog scope (e.g. PC software, board games, non-gaming electronics).
We may decline to buy any item at our discretion if we believe it falls into one of these categories.
Delivery: three ways to get items to us
- Local pickup: free, within our service area (Durham region and parts of Toronto GTA). You pick a time slot; we confirm by email and come to your address.
- Free prepaid shipping label, available on batches with a catalog estimate of $300 or more. We auto-generate a Canada Post or UPS label the moment you submit, email it to you, and you have 72 hours to drop the package off. Unused labels are voided automatically.
- Ship at your own cost, you arrange and pay for shipping yourself. Make sure to give us the tracking number so we know to expect it.
Once items leave your hands, please pack them carefully. XPGames isn't responsible for damage that happens in transit before the package reaches us.
Payment
We pay one of two ways, depending on how items reach us:
- Local pickup: cash or Interac e-Transfer on the spot, the moment we collect the items.
- Shipping (either kind): Interac e-Transfer within 24 to 48 hours of the package arriving and being verified.
Payments go to the email address on your XPGames account. Please make sure it matches the one your bank's e-Transfer system recognizes.
Your account
You agree to:
- Give us accurate information when you sign up and submit batches.
- Keep your password secure and not share your account.
- Only sell items you own and have the right to sell.
- Not abuse, scrape, or attempt to break the site.
We can suspend or close accounts that we reasonably believe are violating these Terms, fraudulent, or being used to cause harm.
Pickup-slot fairness
Pickup slots are first-come, first-served. If you book a slot and don't hand over the items when we arrive (and didn't let us know ahead of time), we may restrict your access to future pickup slots and ask you to use a shipping option instead.
Disputes
We genuinely want every transaction to feel fair. If you're unhappy with something, whether a deduction, a payment delay, or a pickup that went sideways, email us first at xpgames4less@gmail.com. We respond fast and almost everything gets resolved in one email exchange.
Limitation of liability
XPGames does its best to operate fairly and accurately, but the site and the service are provided “as is.” To the maximum extent permitted by Ontario law:
- Our liability for any one submission is capped at the value of that submission, i.e. the total we would have paid you for that batch.
- We aren't liable for indirect or consequential losses (lost profits, lost time, etc.) related to your use of the site.
Nothing in this section limits any rights you have under the Consumer Protection Act, 2002 (Ontario) that cannot legally be waived.
Governing law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada that apply in Ontario. Any dispute that can't be worked out by email and that ends up in court will be heard in the courts of Ontario.
Changes to these Terms
We may update these Terms occasionally, for example when our service changes or laws change. We'll update the “last updated” date at the top. For material changes we'll also email registered users. Continued use of the site after a change means you accept the updated Terms.
